This End User License Agreement ("EULA") is a legal agreement between you ("User" or "you") and LineSpotting AB ("Licensor", "we", "us") for the PulseForge software application and related materials (the "Licensed Application"), including iPhone, Android, and Apple Watch components.
By installing or using the Licensed Application, you agree to this EULA. If you do not agree, do not install or use the application.
Subject to your compliance with this EULA and our Terms of Service, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable licence to download, install, and use one copy of the Licensed Application on devices you own or control, solely for your personal, non-commercial fitness use.
Except as expressly permitted, you may not:
The Licensed Application is licensed, not sold. LineSpotting AB and its licensors retain all rights, title, and interest in the software, workout content, videos, trademarks, and documentation. This EULA does not grant you any rights to our brand assets except as needed to use the app as intended.
If you obtained the Licensed Application through the Apple App Store or Google Play:
We may provide updates, patches, or new versions. Updates may be required for continued use. Updates are subject to this EULA unless accompanied by separate terms.
Optional digital goods (e.g. Lifetime Unlock, Data Vault) are licensed for use within the Licensed Application under the same terms as the app itself. Purchases are fulfilled through the applicable app store. See our Terms of Service for purchase details.
Your use of the Licensed Application is also governed by our Privacy Policy. Workout and health data are primarily stored on your device. Account credentials for email sign-in are handled by our authentication service as described in the Privacy Policy.
This licence is effective until terminated. It terminates automatically if you fail to comply with any term. Upon termination you must cease use and uninstall the Licensed Application. Sections that by nature should survive (ownership, disclaimers, limitations of liability) will survive termination.
THE LICENSED APPLICATION IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Licensed Application will be error-free, uninterrupted, or free of harmful components, or that it will meet your requirements.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LINESPOTTING AB BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE LICENSED APPLICATION.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID FOR IN-APP PURCHASES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED (100) SEK.
Some jurisdictions do not allow certain limitations; in those cases our liability is limited to the minimum permitted by law.
You agree to comply with applicable export control and sanctions laws. You represent that you are not located in a country subject to comprehensive embargo and are not on any restricted party list.
This EULA is governed by the laws of Sweden. Swedish courts shall have jurisdiction, without prejudice to mandatory consumer protections in your country of residence within the EU/EEA.
